Judge Dismisses Consolidated Suit against Medtronic

A Minnesota district court judge has dismissed a consolidated lawsuit brought by individuals and companies against Medtronic Inc. Lawsuits had been filed against Medtronic by many individuals and companies because of serious injury and death incurring as a result of a malfunctioning implantable cardioverter. The product was recalled in 2007 after the company realized that the lead in the product would fracture and cause serious injuries and even death. District Court Judge Richard Kyle dismissed the consolidated lawsuit against the company noting a test by the Food and Drug Administration.

Even though the lawsuits have been dismissed by the judge, the plaintiffs will still be allowed to appeal their cases, request a hearing, or re-pleading the case with new specifics after evaluating the FDA approval documents released for the product.
